2. No Legal Advice
Nothing on this website, in our audit reports, in our email communications, or in any other deliverable we provide constitutes legal advice. In particular:
- Our statements about legal risk, litigation trends, or compliance requirements are general educational information and do not constitute legal opinions.
- The fact that we describe a feature of your website as non-compliant with WCAG or as a legal risk does not mean we are predicting any specific legal outcome.
- Our reports are not a substitute for legal counsel if you are facing, or anticipate facing, ADA litigation, regulatory action, or procurement disputes.

3. Scope and Limitations of Audit Services
Auditable's accessibility audits evaluate a defined scope of web pages and user flows against the Web Content Accessibility Guidelines (WCAG) as agreed in your engagement. You should be aware of the following limitations:
- Scope is defined at engagement: Only the pages and user flows included in the agreed scope are tested. We make no representations about the accessibility of pages outside that scope.
- Point-in-time assessment: An audit reflects the accessibility state of your website at the time testing was conducted. Changes made to your site after the audit — including content updates, template changes, third-party scripts, or new features — may introduce new accessibility barriers.
- No audit is exhaustive: WCAG contains both objective (pass/fail) and subjective criteria. Our auditors apply professional judgment to subjective criteria. Another auditor may reach different conclusions on specific issues, particularly for criteria related to cognitive accessibility, plain language, or sufficient context.
- Third-party content: We do not audit third-party widgets, embedded iframes, or external scripts unless specifically included in scope and accessible to our testing tools. Many websites include third-party components (maps, payment processors, chatbots) that may have independent accessibility issues beyond the client's direct control.
- Dynamic content: Highly dynamic content, A/B tested pages, personalized content, and content behind authentication may not be fully captured even where we test authenticated states. We test what is accessible to us during the testing period.
4. No Guarantee of Full Compliance
Auditable does not guarantee that completing an audit or remediating identified issues will result in full WCAG 2.1 AA compliance, ADA compliance, Section 508 compliance, or compliance with any other accessibility standard or law. We further do not guarantee that:
- Remediating issues identified in our report will prevent or resolve any legal action.
- Completing all recommended remediations will render your site fully accessible to all users with disabilities.
- A passing score or positive conformance statement from Auditable will be accepted as sufficient compliance documentation by any regulator, court, or government body.
- Our audit will identify every accessibility barrier present on your site.
Accessibility is an ongoing process. We recommend regular re-audits (at minimum annually, or following major site changes) to maintain your accessibility posture.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Auditable and its employees, contractors, and agents shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or reliance on, our services, reports, or website.
- Any legal outcome, regulatory determination, or business loss arising from accessibility issues identified or not identified in our reports.
- Any losses arising from changes to your website after the date of testing that introduce new accessibility barriers.
- Any claim that our reports are incomplete, inaccurate, or fail to identify specific accessibility barriers.
- Any damages arising from your failure to implement our remediation recommendations.
In any case where liability is established, our maximum liability to you shall not exceed the total fees paid by you to Auditable for the specific engagement giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the above limitations may not apply to you to the extent required by law.
6. Accuracy of Website Information
While we make every effort to ensure the information on this website is accurate and up-to-date, Auditable makes no warranty, express or implied, that the content of this website is complete, accurate, or free of errors. Accessibility standards, legal requirements, and industry practices evolve — information on this site may not reflect the most recent developments.

8. Intellectual Property
The Auditable name, logo, asterisk mark, and all website content — including text, design, code, and report templates — are the intellectual property of Auditable. All rights reserved.
Audit reports delivered to clients are licensed for the client's internal use, external publication, and use in legal or procurement proceedings. You may not resell, redistribute, or sublicense audit reports to third parties without prior written consent.
You retain all rights to your website content and code. By engaging our services, you grant Auditable a limited, non-exclusive license to access and analyze your website solely for the purpose of delivering the agreed audit services.

Data Retention
We retain your contact information and engagement records for up to 3 years following the completion of your engagement, for record-keeping and potential re-engagement purposes. Audit reports are retained for the same period. You may request deletion of your information at any time by emailing auditable.contact@gmail.com.
Test credentials provided for authenticated page testing are deleted immediately upon completion of manual testing — they are never stored beyond the testing period.
